FULTON COUNTY BOARD

REGULAR SESSION

JANUARY 09, 2007

Chairman Edward L. Ketcham called the Regular Session, January 09, 2007 meeting to order at 6:30 p. m. in Courtroom 201 at the Fulton County Courthouse in Lewistown, IL.

The Fulton County Clerk called the roll and found the following members present:

The Invocation was given by Member Shaw which was followed by the Pledge of Allegiance to the Flag by Board members and guests. 

Member LaRiviere moved to accept and place on file the Recessed Session September 11, 2006 held November 28, 2006 with a second from Member Bucher.  The motion carried by voice vote.

Member LaRiviere moved to accept and place on file the Minutes of the Reorganizational Session held December 6, 2006 with a second from Member Bucher.  The motion carried by voice vote.

Member Pettet moved to accept and place of file the Minutes of the Regular Session held December 12, 2006 with a second from Member Kumer.  The motion carried by voice vote.

ANNOUNCEMENTS, COMMUNICATION AND CORRESPONDENCE

Member Manock moved to adopt the Resolution appointing George Hall as the new Fulton County Board Member from District 1 to replace resigned Member Jason Norton.  The Fulton County Clerk, James I. Nelson swore in the newly appointed board member and Member Hall was respectively seated with the Finance/Insurance, Property and Personnel & Legislative Committees.  Member Hall’s term will end November 30, 2008.  Member Shaw seconded the motion.  The motion carried by roll call vote (19-0).

CONSENT AGENDA

 

Member Manock moved to approve the Consent Agenda with a second from Member Huggins.  The motion carried by roll call vote (19-0).

ACTION AGENDA

PUBLIC WORKS AND HIGHWAY DEPARTMENT

Member Manock moved to adopt the Resolution authorizing Federal Aid Matching Funds for Right-of-Way Acquisition on County Highway #6 Project 03-00125-RS with a second from Member LaRiviere.  The motion carried by roll call vote (19-0).

Member Manock moved to adopt the Resolution authorizing Donation of Right-of Way on County Highway # 6 Project Section 03-00125-00-RS with a second from Member LaRiviere.  The motion carried by roll call vote (19-0).

FINANCE/INSURANCE COMMITTEE

Member Manock moved to pay the claim in the amount of $1,664.81 pursuant to the Fees and Salaries Act (5 ILCS 290/3.2 and 5 ILCS 290/3.3) the Counties in each judicial circuit shall reimburse the State Treasury for each additional $500.00 salary paid to judges in their circuit.  Member Bucher seconded the motion. The motion carried by roll call vote (19-0).

Member Manock moved to pay the claim in the amount of $16,580.00 to Clifton Gunderson for professional services from November 16, 2006 through December 22, 2006 for progress billing on audit of November 30, 2006 financial statements and progress billing on November 30, 2006 Circuit Clerk Office Audit with a second from Member Bucher. The motion carried by roll call vote (18-1). Nay-Member Abbadusky.

Member Manock moved to pay the claim in the amount of $40,984.09 to Foster-Jacobs for General Work in regards to the electrical updates at the Fulton County Courthouse with a second from Member LaRiviere.  The motion carried by roll call vote (19-0).

Member Manock moved to pay the claim in the amount of $14,094.96 to AMEREN- CIPS for the total cost to remove the existing 150KVA transformer and install a new 300KVA transformer with as second from Member Bucher.  The motion carried by roll call vote (19-0).

Member Manock moved to pay the claim in the amount of $1,049.26 to Phillips and Associates for pre-construction phases of the electrical updates at the Fulton County Courthouse with a second from Member Bucher.  The motion carried by roll call vote (19-0).

Member Manock moved to pay the claim in the amount of $11,885.00 to the Heart of Illinois Regional Port District 2007 Executive Director of Transport support with a second from Member Bucher.  The motion carried by roll call vote (19-0).

Member Manock moved to adopt the Resolution directing the Fulton County Treasurer to deposit said fines into a new savings account called State’s Pet Population Control, and that the following indicating budget line items are hereby appropriated from unappropriated funds to meet an immediate emergency into the County’s State’s Pet Population Control Fund #53 with a second from Member Bucher.  The motion carried by roll call vote (19-0).

Member Manock moved to adopt the Resolution in which $2,000.00 be appropriated to meet an immediate emergency in to the County General Fund, Planning & Zoning line item #001-516.201-015, Mileage Expense and that the following indicated budget transfers within the Fulton County General Fund be ordered as follows:  $2,000.00 from Office Supplies and Expense #001-520.301-015 to Mileage Expense #001-516.201-015 with a second from Member Bucher.  The motion carried by roll call vote (19-0).

Member Manock moved to adopt the Resolution to pay $300.00 from unappropriated funds to meet an emergency into the County General Fund, Public Defender #001-530.100-022 Illinois Bar Association Dues with a second from Member Bucher.  The motion was defeated by roll call vote (11-8).  Nays-Members Abbadusky, Andrews, Huggins, Kumer, Monari, Pettet, D. Zessin, R. Zessin. 

Member Manock moved to accept and place on file the Circuit Clerk’s Six Month’s Report with a second from Member Bucher.  The motion carried by voice vote.

PERSONNEL & LEGISLATION

Member Abbadusky moved to adopt the Resolution appointing Charles E. Fleming to the Cuba Fire Protection District to replace resigned Trustee George Spires until the first Monday in May 2009.  Member Kumer second the motion.  The motion carried by roll call vote (19-0).

Member Abbadusky moved to adopt the Resolution appointing James Maxwell to the Buckheart Fire Protection District to replace resigned Trustee Ralph Smith until the first Monday in May 2008.  Member Monari second the motion.  The motion carried by roll call vote (19-0).

OTHER

Chairman Ketcham had County Clerk Nelson read a letter from the Office of the Attorney General Lisa Madigan dated December 4, 2006 about a complaint alleging that Fulton County Board members were discussing public matters outside of the context of a public meeting held on November 14, 2006 concerning the Open Meetings Act for Executive Sessions. After discussion on the floor, County Clerk Nelson will contact Kevin McGuire about a training session regarding the Open Meetings Act through the U of I Extension Service Continuing Education Program. Also, State’s Attorney John Clark will be putting together a brief information letter of do’s and don’ts regarding the Open Meetings Act for Fulton County Board members.

Chairman Ketcham set an Ad Hoc Committee for County Administrator consisting of Doreen Shaw, Neil Williams, Linda Helle, Chairman Ketcham and County Clerk Nelson.  Member Manock moved to accept with a second from Member Simmons. The motion carried by voice vote.

County Clerk Nelson brought to the Board’s attention to the flyer from the U of I Extension Service A Series of Local Government Education Tele- Institutes for continuing education classes for local government appointed/elected officials.

ADJOURNMENT

Member Bucher moved to adjourn the meeting with a second from Member LaRiviere. The motion carried by voice vote with the meeting adjourning approximately at 7:44 pm.  The next Fulton County Board meeting will be Feb. 13, 2007 at 6:30 pm, Courtroom 201.
