Fulton County Planning and Zoning Office

The Fulton County Office of Planning and Zoning is responsible for regulating construction and use activities in the unincorporated areas of the County. The Office also regulates zoning laws for the villages of: Ellisville, London Mills, Marietta, Smithfield, Bryant, Banner, Liverpool, and Vermont. If a resident in any of the above named areas wishes to build in his/her Zoning District, this Office is responsible for overseeing the issuance of building permits.
 

Zoning Board of Appeals

Persons wishing to perform work or services in a Zoning District where some activities may be restricted may file a petition with the Board of Appeals. All Zoning Districts have certain activities which may be performed under a qualifying “conditional use.” Other activities may be performed under “Special Home Occupation Permits.” Buildings which may be too close to property lines can still be constructed via Board approval of a “setback variance.” Other duties of the Appeal Board include requests for changes in zoning classifications (map amendments) and appeals of a determination made by the Zoning Enforcement Officer.

The Zoning Board of Appeals consists of seven members, appointed by the County Board. Their terms are for five years. They are county residents, all from different townships.

Flood Plain Administrator

The Zoning Enforcement Officer administers the County Special Flood Hazard Area Ordinance. There are numerous flood hazard areas in the County due to Spoon River which cuts through the heart of the County, the many small streams which feed into Spoon River and the Illinois River which is the eastern boundary of the County. Building in a special flood hazard area is prohibited unless the land owner can meet strict rules governing construction in such an area. Contact the Zoning Office to learn if your property is in a flood hazard zone.
